2. These terms

These Terms of Use govern your access to and use of absher-ai.com and any subdomain we operate (the "Website"). By using the Website you accept these terms. If you do not accept them, please do not use the Website.

These terms cover the Website only. If your organisation deploys Absher voice agents, that relationship is governed by our Service Terms together with the order form or pilot agreement signed with us, which take precedence over these terms in the event of conflict.

3. What this Website is

The Website describes our products and publishes articles, documentation and company information. It is provided for general information. Nothing on it is an offer capable of acceptance, a warranty, a commitment to deliver a specific feature, or professional, legal, financial or regulatory advice.

Product descriptions, screenshots, roadmaps and forward-looking statements describe our current intentions and may change without notice.

4. Demonstrations and AI-generated output

Parts of the Website may let you interact with a demonstration voice or chat agent, or play a recording of one. Where that happens:

  • You are interacting with an artificial intelligence system, not a human being. We disclose this in the interface and will continue to do so.
  • Output is generated automatically and may be inaccurate, incomplete or unsuitable for your circumstances. Do not rely on it.
  • Demonstration agents are not connected to any live account, booking system or customer record.
  • Please do not enter personal data about other people, confidential information, payment card details, health information or credentials into a demonstration.

5. Waiting list, contact forms and communications

Where the Website invites you to join a waiting list, request a demonstration or contact us, you agree that the information you submit is accurate and that you are entitled to submit it. If you provide another person's details, you confirm you have their permission.

Joining a waiting list does not create a contract, reserve capacity, guarantee access, or oblige us to make the product available to you. We may contact you about your request and about Absher. You can unsubscribe from marketing messages at any time using the link in any message, or by writing to contact@absher-ai.com.

6. Acceptable use

You may view, download and print material from the Website for your own information and for evaluating Absher. You must not:

  • use the Website unlawfully, or in breach of any applicable sanctions, export control or telecommunications rules;
  • copy, republish or exploit our content commercially without our written permission, other than short quotations with attribution and a link;
  • scrape, crawl or harvest the Website, or use automated means to extract content or contact details, except that well behaved search engine crawlers may index public pages;
  • use Website content, including any text, audio or voice sample published on it, to train, fine tune or evaluate a machine learning model without our prior written consent;
  • attempt to gain unauthorised access to the Website or any connected system, probe or test its security, or interfere with its operation;
  • introduce malware, or send unsolicited or bulk communications through any form on the Website;
  • impersonate any person, or misrepresent your affiliation with any organisation;
  • remove or obscure any notice of copyright, trade mark or ownership.

7. Intellectual property

The Website and its content, including text, graphics, illustrations, audio, software, and the Absher name, logo and wordmark, are owned by us or licensed to us and are protected by intellectual property law. Nothing in these terms transfers any right in them to you.

Third party names and marks appearing on the Website belong to their owners and are used for identification only. Their appearance does not imply endorsement or partnership unless we say so expressly.

8. Your feedback

If you send us ideas, suggestions or feedback about Absher, you grant us a perpetual, worldwide, royalty free licence to use them without restriction or obligation to you. Please do not send us anything you consider confidential.

9. Third party links and services

The Website links to sites and services we do not control, and embeds third party components such as analytics and anti-abuse tools. We are not responsible for third party content, availability or privacy practices. Your use of a third party site is governed by that party's terms.

10. Availability and changes

We aim to keep the Website available but we do not promise uninterrupted access. We may suspend, withdraw, restrict or change all or part of the Website at any time, including for maintenance, without notice or liability.

We may update these terms. The version published here is the one that applies. Where a change is material we will update the date above, and we will give reasonable notice where we are required to. Continuing to use the Website after a change means you accept the revised terms.

11. Disclaimers

The Website is provided on an "as is" and "as available" basis. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited.

Subject to that, and to the fullest extent permitted by law, we are not liable to you for any loss of profit, revenue, business, goodwill, anticipated savings or data, or for any indirect or consequential loss, arising from your use of or inability to use the Website or from reliance on its content. If you are a consumer resident in the European Union or the United Kingdom, this choice does not deprive you of the protection of mandatory consumer law in your country of residence, and you may bring proceedings in your local courts.

We are established in Tunisia and remain subject to Tunisian law in respect of our own corporate obligations.

16. General

If any provision of these terms is found unenforceable, the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms. There are no third party beneficiaries. These terms, together with the documents referred to in them, are the entire agreement between us regarding the Website.
